Full Release & Waiver of Liability Agreement for Saiunkan and Victory Assembly of God, The Southern U.S. Kendo & Iaido Federation and The All U.S. Kendo Federation.

I/We fully understand and acknowledge that:
While Kendo, Iaido and related activities are some of the safest martial arts presently practiced, as with any athletic endeavor or sport, there is the risk of injury. Further, while the Instructors and Seniors providing guidance will always endeavor to provide the safest instruction possible, there is always the possibility of misunderstandings and miscommunication that could result in injury. It is highly recommended that you consult with your physician prior to initiating practice to ensure that you are healthy enough to participate in the activity.
Further, I hereby agree to abide by the commands and instructions of the Instructors and Seniors of Saiunkan and I understand that their decisions regarding all issues involved in the practice of the martial arts and associated activities are final and binding on me.
I also understand that here may be other risks not known nor reasonably forseeable at this time, and I undertake the practice Kendo, Iaido and related activities with this clear understanding.
I also understand that Victory Assembly of God, 1017 W Byrd Blvd, Universal City, TX 78148 has no affiliation or association with the practice of Kendo, Iaido and related activities that are being practiced in its gymnasium other than as lessor and that Victory Assembly of God bears no responsibility or liability for that practice.

I accept and assume such risks and responsibility for the losses and/or damages following any injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees named herein.

We HEREBY WAIVE, RELEASE, DISCHARGE AND COVENANT NOT TO SUE the facility used by the participant, including its owners, managers, promoters, leasor and leasee(s) of the premises used to conduct any activities at the premises. I hereby release the other participants, instructors, senior and junior members of the organization and associated entities including, but not limited to Houston Kenshikan, Inc. and St. Andrew Lutheran Church from any act or inaction that could or does result in any harm or bodily injury to myself or child as named herein.

I HEREBY acknowledge that martial art activities are dangerous and involve the risk of serious injury, paralysis and death. In addition, I could incur significant medical, social and/or economic damages as a result of incurring any such serious injury, paralysis or death.

I HEREBY WAIVE AND RELEASE ANY AND ALL FELLOW PARTICIPANTS AND INSTRUCTORS FROM ANY AND ALL RESPONSIBILITY FOR ANY ACTIONS, INACTIONS, INCLUDING ANY FUTURE NEGLIGENCE, THAT COULD RESULT IN INJURY TO MYSELF OR ANY MINOR CHILD FOR WHO I AM PARENT OR GUARDIAN. I ASSUME ALL RISKS FROM ANY MARTIAL ARTS ACTIVITIES I PARTICIPATE IN AT SAIUNKAN LLC AND VICTORY ASSEMBLY OF GOD, THE SOUTHERN U.S. KENDO & IAIDO FEDERATION AND THE ALL U.S. KENDO FEDERATION. IN ADDITION, I UNDERSTAND THERE COULD BE A THE RISK OF EXPOSURE TO COMMUNICABLE SICKNESS/DISEASE INCLUDING, BUT NOT LIMITED TO COVID-19 AND I RELEASE ALL PARTIES AND PERSONS FROM ANY LIABILITY FOR THIS POSSIBLE EXPOSURE.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT AND INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONALLY RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.on this box I hereby expressly state that I have read and agree to be bound by the terms and conditions waiving certain rights unconditionally.
